Shocking service so far. Paid a £500 pound holding deposit for a flat to then be told 2 days before I was to move in that the landlord had pulled out. I have been trying for the last 3 weeks to get my holding deposit back. I have been phoning everyday, emailing etc but getting no response. One week ago I eventually received a response from Dawn saying that she will transfer the money to me that day-one week on still received nothing. Dawn, you seem to have taken time to reply to these reviews yesterday and not bothered to get back to me, so hopefully I might get a response from you this way?

Can you please inform me why the locks to the property were changed without our knowledge or consent?
Will you be so kind to forward invoices for work which you claim was carried out?
Finally, bank records show that the final rent payment was deposited into the account by LA Lettings on 26th Noverber. The tenant moved out on 10 January. When do you intend to forward the balance to us?
I eagerly await your response.

Dawn- I have no intention of starting an argument with you. I am sure you can understand that I am just frustrated as you seem to picking up on points that are irrelevant and not answering my main question which is why you have not returned my deposit?? I have nothing else to say on this matter I have been in touch with my solicitor and Trading Standards who will picking up on this matter and will making contact with you shortly.

Hi Sarah, thanks for your email, I will be responding to you privately in the next few days. What I fail to understand is why Dawn will not return your deposit. It seems a pretty straight-forward transaction. Holding back deposit/final rent payments appears to be a common theme judging by the comments on this forum. There appears to be, although not as yet proven, a lot of illegal activity happening. Hopefully this can be ascertained one way or another.

It was always going to be the 1st of March, right at the start when we went to view the flat we were hoping for the 16th of March but was advised by yourself that the landlord did not want a contract from the middle of the month and wanted this to start from the 1st. This was completely understandable and we arranged for removals etc for the1st. It was LA Lettings that made the mistake when writing up the contract, we then emailed them to advise of their error and we received a new contract with the 1st of March. Again we have a full history of emails to prove this.

There is no comment about the offer of another property as it is completely irrelevant to my review. My review was highlighting the fact that we have still not received our £500 holding deposit. If you do want to bring up this point, the other property you offered us was disgusting. It was completely unsafe with wires hanging out of lights in the bathroom and there was so much mould and dampness that the floor and walls disintegrating. On top of this you had the cheek to charge this at £460 per month! The matter of the fact is all this nit picking is completely irrelevant. I made a review highlighting the fact that I have not received my deposit from you when it was down to you or the landlord’s discretion to pull out, no fault of mine. I do not understand why you would rather start an argument on a public website and show yourself and your company in your true nasty colours rather then email me back privately and sort out the matter.

Sarah you gave LA Lettings the date of the 16th March but decided that because you were able to sign the contract from the 1st of March you arranged removals for this date. This was notified to us only two days before. I note there is no comment regarding the offer of another property which you were offered!

Helen, can you comment with the name and address of the ombudsman. My understanding is that LA Lettings have not signed up with a regulatory body which is not surprising.

Can you please confirm the evidence that states we had a 2 week notice that the landlord withdrew the flat? That is a complete lie, we had 2 days! Our contract was due to start on the 1st of March and we were notified on Thursday 27th Feb and I have email and text messages from Dawn to prove this. In terms of our £500 holding deposit (which we have been advised is actually illegal in Scotland) we have been trying to get this refunded since the 27th of Feb. We eventually received an email from Dawn on the 12th of March stating she would be refunding the money that day. Shock-we have still not received anything. We also stated to Dawn we wanted this by bank transfer as this was the way we paid her not by cheque. Dawn now has until Mon 24th of March for money to be in our bank account before we start legal proceedings.

Steve-I have rented for years and I have never encountered a company like this in my life. Complete lies and the worst customer service I have ever experienced. If you want to send me your email address and we can discuss this further

Sarah you approached us looking for a property on a short term basis (3 months) which most agencies do not do. We did find you a property but yes you are correct, the landlord withdrew but you had a fortnight before you were actually due to move and not two days! We offered you another property which you refused. Dawn has replied to your partner and agreed to return your deposit and we have received an e-mail just yesterday confirming the address it should be sent to. This will be sent by recorded delivery to ensure you do receive it.

Sarah I would not hold your breath. The chances of getting your money back are pretty slim judging by Dawn's previous actions. I am currently investigating a number of options in order to retrieve both property and money owed to my family as well as highlighting the behaviour of this company. Update - I heard via Fife Trading Standards LA Lettings had left their office in Crossgates without notice 2 months ago ,leaving an unhappy landlord. Unhappy customers need to be vigilant as this company could appear again. ...

After Dawn read this review she contacted us, she made us aware that she wasn't receiving our emails.....(still trying to work out why that should make a difference to our payment), however, she informed us this would be sorted out that day... Well guess what... This particular tenancy was a tenant find only for one of our landlords who wished to manage the property themselves, so after moving the tenant in which was on the 28th of April 2011, we have had no contact with this tenant until now! As in our discussion you and another Landlord (Amie Mee) have been unable to retract the comments written out of frustration from the ongoing issues with these properties. The issues have involved myself, Frontline Fife, Fife Council and various other government departments due to noise complaints etc. It has not been an easy time, however there are lovely new tenants in both properties who are looking after these homes. What agent could do to change your mind?
A few points for Dawn below- Inadequate duty of care and obligations to me as a client landlord and not meeting my aims or needs- also neither treating my clinets nor myself with fairlness or integrity. You did not have an in hosue complaints procedure -this should be readily available for me and the Property You did not provide me with appropriate, regular statement of income and expenditure in fact you often forgot statements as well as renumeration some months. You failed to keep suitable records of repairs, maintenance etc carried out on behalf of the client and in fact did not ensure any air of urgency required in carrying out jobs regardless of the perfect initial presentation of the property. Finally and most damnable is your reluctance/ refusal to pay over to each relevent party any amount of the deposit deposit that is not subject to a dispute, as soon as administratively practicable!!!!

You can report her to the Information Commissioner for breach of the Data Protection Act. As she was never legally incorporated, you should report her personally. She's still living in the local area and is now an employee, so can easily be traced through HMRC.....who are also talking to her about trading while insolvent and other criminal offences. If she's not bankrupt, she will be soon enough, so civil proceedings for breach of contract are probably not worth the effort. ...
