I am forced to pay service charces to HLM, which I totally and utterly despise for their incompetence in providing any kind of maintanance and security services to Harrow Court, in Rugeley, the Walton Homes complex where my house is located at.
I have sent numerous emails, made countless phone calls and HLM has not sorted either the security of the complex, where cars and houses get vandalised, or resolved the incessant illegal parking at the block paving and visitors allicated spaces.
I have asked many tines HLM to implement a few security cameras to avoid both issues from happening and I greeted with apathy and excuses as to why they cannot implemment them. Budgetting being the main excuse.
Many residents in the complex got involved with the police as a result of such crimes like vandalism but nothing can be done because the land is private and HLM should be aorting the issues they are paid for choose to treat us with the utmost disregard.
I keep sending emails, ringing, taking photos to prove it and I feel that the only way I will see all these issues sorted would be going to a solicitor. However, why should I be made to trow yet more money to sort issues, which should be resolved by HLM???
I have asked HLM to repair a couple of broken bricks near my driving and I never got a reply regarding this third issue, which I suppose, in the scale of things, is not so urgent. WHY should I loose my health pressurising HLN to act when they are just trying to ignore me or the horrible things I've been subjected to?
I need help so that I can perhaps break free from this white elephant HLM really is.

Do you think is somehow legally possible to break free from this buabolic company HLM? Could you help me please?

It looks like your development is around 9 houses, with a joint private road and some communal landscape areas. Therefore, your S/C should be fairly nominal. Is Walton Homes still the Freeholder? Technically, HLM report to them as "the Client", however that doesn't mean they should ignore complaints. HLM are also part of "Countrywide", who are affiliated to the RICS (Royal Institution of Chartered Surveyors). I suggest you refer to the RICS web site, and download the "Code of Practice for Service Charges, 3rd Edition", then read it carefully. That will give you a benchmark as to what should be expected of HLM. Note that there should be a "Complaints Procedure" which is applicable to Leaseholders, so, in the first instance, write a reasoned, reasonably brief but comprehensive letter of complaint, quoting dates of E-Mails, telephone calls etc., and calling it a "Formal Complaint". Send to HLM, & copy to Countrywide HQ (I think still in Chelmsford, Essex). Await initial response, which should be within 14 days.Always try a fair, but firm, approach to start with. There are other avenues available, such as the FTT, Arbitration, but try that one first. I have to say, getting rid of an incompetent MA through the Midlands Tribunal, is like taking out teeth - very painful, expensive & unsatisfactory. One does have to remember, though, that if you want to improve security, such as erect an electric gate, then it will cost money to both install and maintain, and you have to get 100% agreement for everyone to pay - not easy, especially if you have some "Buy To Let" owners on the estate. Hope that gives you some ideas.
