I am the owner of Shining Tree, the owner and seller of the property that Mr Genn is referring to.
Andrew Hadley our agent who represent Bradleys is professional, efficient, honest and has guided and supported us through this journey in the selling of Shining Tree.
His job is to introduce our property to prospective buyers and then we show the buyers around and give them all the information we can about our property.
We have givien Mr Genn all relevant information concerning the boundaries of our property, right of way, all maintenance and servicing of various plants and machinery relevant to the centre. We have even given Mr Genn detailed run down of our overheads and relevant income at the centre. So we have tried to be as helpful and as transparent as we can be.
Concerning building insurance. We have had the same provider for the last 16 years. First it was completely as commercial buildings and then as part commercial and part residential when the Old Gym had change of use to residential.
I passed my insurance broker's details to Mr Genn.
I had assume that it would be as simple as changing the policy over to the new owners but apparently its not as simple as that , as a lot has changed in the last sixteen years. So it would have to be a new application. Bearing in mind that ite a mixed use premises and not as straight forward as insuring a 4 bed house.
This is what Richard, our insurance broker said to Mr Genn:
"I understand that Mr Genn has pulled out of the purchase of your property and that he has cited the reason as being that he couldn't get insurance.
I can confirm that at no time did I tell Mr Genn that we couldn't get him an Insurance quote.
I did say to him that due to the property's location and proposed use, it was not a straightforward risk and that it would almost certainly not fit onto a typical Insurance Quote website.
I explained this to him so as to manage his expectation in terms of timescales and suchlike.
Many years of experience have taught me that it is important to keep clients fully up to dated and as such I emailed Mr Genn on October 15th advising that we were struggling to get him a quote but that we had other markets still to explore.
As I wished to avoid the situation where the full responsibility for obtaining a quote rested on my head, I did suggest that it would be prudent for Mr Genn to explore his own avenues."
We have sold a farm house , and two meaning plots which have been built on as houses. All have building insurance. So cannot understand why Mr Genn say he cannot find a broker for insurance?
We had two more second viewing this last weekend since Mr Genn pulled out the sale. I make the point now of telling prospective buyer about insurance to avoid any complications.
The non refundable fee was agreed between myself and the agent as I had been badly let down before. Mr Genn was well aware it was non refundable before he paid it as it was needed to cover my legal expenses in the event of withdrawal and to discourage time wasters. The deposit was forwarded to me less an admin fee to cover my costs and I consider this to be the action of a responsible agent looking after his clients.
