We refer to your recent review and offer the following response.
Rental Arrears
The Tenancy you refer to was between 2014 - 2016. The Tenancy fell into arrears due to a repair issue with the balcony door and the delay in fitting a new door which left the apartment not secure. The tenants refused to pay full rental until the disrepair issue had been resolved. You authorised the repair and sent funds, the repair was then carried out. O'Connor Bowden, took reasonable steps to recoup the rental arrears, by way of a full reclaim against the deposit and demands sent to their forwarding address. O'Connor Bowden were successful in reclaiming around 90% of the rental arrears. We note a balance is outstanding from the tenants and we have attempted to reclaim by using tracing agents who have been unsuccessful at locating the tenants current address. We have also advised you on the necessary court action you can take in this regard.
No Agent accepts liability for rental arrears, in this regard we can only take steps to recover rental arrears that are within UK Law/guidelines to recover funds.
Rental Monies
A check of you account for the last financial year, identifies that you have been paid on a monthly basis and within the payment terms outlined in your Terms Of Business.
Meter Readings
We supplied you meter readings, which you advised were incorrect. Whilst O'Connor Bowden requests meter reads, it is the Building Manager - Comptons that supplies these to Agents and Leaseholders, if the information is incorrect - complaint would need to be raised with them.
We understand you were not happy that we would not retrieve readings to be used for the completion of the sale of the property, however as the Tenancy expired in October 2018, O'Connor Bowden would not deal with this request as the Management agreement had terminated.
