We signed a contract with Zack stating a solid move in date. This was then delayed days before we were due to move in. We had paid a holding deposit and security deposit. In total they have around £2300 of our money. The move in date was continuously delayed - going on for about 3 weeks. We were effectively homeless - staying with friends, and significantly out of pocket. We requested a full refund so that we could find somewhere else to live which he kept promising but we never received. When we finally managed to speak to the director of this estate agents, Shah Uddin, he said that Zack no longer worked for him, wouldn't give us his surname, and it wasn't his problem and that we should go to the landlord's house to request the money back (the money should have gone into the DPS - not the landlords account). A solicitors letter prompted the director to say that he would try to get the money back - we then received a text message from Zack (he only ever communicated via text - he wouldn't answer his phone) and he apologised profusely, he understood that solicitors and the authorities were involved, and said that he no longer had the money, he needed more time. At this point we had already found another property but lost it because we weren't able to pay the deposit quickly enough because Zack still had our money. We still haven't had it back. This estate agent is not affiliated with any regulatory body and the director was not prepared to assist in the recovery of our money nor would he accept responsibility for his member of staff. We believe there to be some sort of corroboration between Zack and the landlord, and since we only met Zack once and never met the director of the estate agents, it could well have been the same man covering for himself by claiming to be the director.

First and foremost I would like to point out that the transactions and dealings with the above mentioned property was not under cosmo homes supervision nor was I aware of this matter until this was brought to light after speaking to Amy Stryczko and juli ( the third party in this matter).
I am very disappointed that you are making a false accusation against Cosmo homes, as we did not receive any monies. You paid directly to the landlady’s account, you thought you can avoid paying the Agency fee, and without consulting with me or cosmo homes, We cannot be responsible for your own action.
If she did not refund your monies then you should take legal action against her. We instructed our solicitor to take legal action against the landlady and the prospective tenants, and as you are aware that the outcome is that you paid to the landlady, and when it fell through you demand the money from cosmo homes which is wrong to do so.
Any false claims against myself or Cosmo Homes will be taken to court for deformation of character.
I hope this clarifies that myself and Cosmo Homes as a company are not involved in any way shape or form and this was soley your action.
