5 reasons why you should NOT use Berkeley Way: 1. They'll keep your deposit Letting agents are contractually obliged to return your deposit within 28 days. Any charge for damage to the property may be deducted and then disputed by the tenant, but the balance must be returned to the tenant. We moved out on 2 September and we are still waiting for our money 42 days later. 2. They charge you for fair wear and tear There is a white mark on the black granite top in the kitchen. We have no idea where that came from - whether from us or from one of the many workmen who visited the property. The check-out clerk told us that this would come under fair wear and tear. We received a copy of his report more than two weeks after we had moved out. The word 'damage' appeared on the report, contrary to what he had told us in person. Berkeley Way told us this mark constituted damage that required the replacement of the entire granite top. They say they are still waiting for a quote for this from the house builder Berkeley Homes (a separate company, despite the similar name). 3. They won't arrange/turn up for work that needs doing We had countless problems with the property that were way beyond the snagging issues you can expect with a new-build. Everything from problems with the electrics to the plumbing, from the locks to the ventilation, from the mirrors (falling off) to alarms beeping - you name it, that house had/has it. This required dozens of visits by workmen and we had to arrange and attend all of them ourselves – Berkeley Way turned up just twice. At least Berkeley Homes had the decency to pay us compensation, but only after four months and then not again, despite a further eight months of problems. Berkeley Way will claim credit for the compensation, but in fact they should have offered a reduction in rent. Instead, they said they were going to increase the rent, by £200/month. 4. They won't return your calls We had to deal with practically every person at Berkeley Way and found them all to be incompetent. And, after moving out, whenever we called, everyone seemed to be in a meeting or out of the office, while the person on the phone appeared to know nothing at all (literally). 5. They exploit Londoners on behalf of overseas ‘investors' Our foreign investor landlord is “fed up†with the problems with the house (that we and not he had had to endure) and has decided to try and sell the property. Berkeley Way have instructed JLL estate agents in Blackheath to do that. They are asking for £1.1 million! The house wasn't worth the rent we paid; it isn't worth a mortgage either. The landlord owns other properties in London; he's very rich in other words. And yet he – through Berkeley Way – plans to charge us for a mark on a kitchen work surface and is still withholding our entire deposit.

15 Oct 2014Dear Claire. Thank you for your comments. Please find below our response, as there are some ommissions and inaccuracies that we need to correct. 1. Deposit – we still hold your deposit under the terms of the tenancy agreement as there is a problem that is ongoing to do with damage to the worktop. On Friday I was in touch with Kelly Beech at Berkeley Homes to try and facilitate a solution at her level as my team are finding it hard to get a price for the worktop from the contractor. The matter is very much pending. There is no requirement to repay a deposit with 28 days, the rules are that a tenant must be aware of why there is an issue and if there is likely to be a deduction. The deposit is still protected and held in our client account and has not been passed to the landlord which of course it could have been if we had no intention of repaying you. So your accusation is unfair and unreasonable. 2. We do not charge for wear and tear. No reasonable person can consider that a mark to a granite worktop in the shape of a circle is wear and tear and not damage from a pan or a chemical spill or something similar. We have asked you if you could tell us the circumstances which again might find making good the damage easier, but your insistence that it is wear and tear is unfair and unreasonable. Remember the house is only one year old. 3. Property visits and compensation and issues with Berkeley Homes. We visited the property on many more occasions than the twice you refer to. The £5,500 compensation from Berkeley Homes would not have been achieved without our intervention and management of the landlord. We all know this to be case otherwise you would have not sought our intervention, advice and expressed gratitude at the time. It is unfair and unreasonable of you to now to have such a selective memory of events. 4. Just this week my colleague spoke to Egor at length, so I am not sure what the ‘unreturned calls’ are. We have explained the position that we need the price for the worktop no matter how threatening you are to us on the phone – or the comments of ‘going to involve the media’ and Twitter etc. We are not incompetent and I am not sure that the other companies that you are copying in will confirm that we are professional in our dealings. 5. Exploitation – the circumstances of the landlord and the ability of JLL as a professional agency to value a property I do not think need to be questioned in the context of a delay in returning a deposit. This again shows that you are being unfair and unreasonable with wild accusations and unfounded comments. I would urge caution as many of these firms will have large legal departments that will take defamation seriously. The deposit will be resolved as soon as we can establish the cost of the damage caused. If it was not such a high value item we could have agreed to release the undisputed amount, but none of us are aware how much it will be to have a new piece of granite cut and fitted. As soon as we do know that then we will be able to make progress and resolve this unpleasant and time consuming issue which is affecting us all.

16 Feb 2015Further to the complaint below, the deposit dispute went to arbitration under the 'MyDeposits' scheme. The arbitrator awarded the landlord over 50% of the deposit in compensation for the damages to the house.

Kindly note that legally, letting agents need to publish information about their tenancy fees, government-approved redress schemes and client money protection schemes on their website and on third party websites (on which agents are listed). For properties to lease/rent in England, agents need to keep this information up to date and precise on allAgents or specify within the property description.
