I haven't had a good experience with this agent and I think that other potential buyers should know about what they are like before they deal with them. So please see the string of emails below between myself and the agent. Sensitive information such as my name, address of the property and amount offered have been removed and replaced with X's: 09/01/2014 --12:51, Buyer Wrote: Dear Alex / Michael / Office Manager Following your calls today regarding the other person who has made the same offer as me at asking price of £XX and has since increased it to £XX in order to win the bid. After speaking with the solicitor that I've put in place to handling the conveyancing, I've been told that what you have done is unethical and is known as gazumping. I offered asking price on 7th January (following the viewing on 6th January) and you told me the offer of £XX was accepted. On the same day I sent you the email below to confirm my mortgage in principle. Therefore no further viewings should have been arranged and no further offers should be considered. Your website states that you are a member of the Property Ombudsman and I have looked into the complaints process. I will follow this complaints process with my solicitor if my offer is now declined because someone else has made an offer and you are telling me that I have to raise my offer by more than an extra £XX in order to be in the running to win the property. I am really looking forward to moving into the property and I'm extremely disappointed that this has happened, particularly from an Estate Agents that appeared to be an ethical and decent company. I look forward to your immediate response on this matter. Should I not hear from you today I will proceed with the complaints process. What agent could do to change your mind?

The agent could have taken the ethical approach and kept their word. I was the first person to view the property and I offered asking price. No further viewings should have been arranged and no further offers should have even been considered. The agent has obviously already replied to my emails as seen above, so I don\'t expect a further response. I have posted this review for the sole purpose of ensuring that other potential buyers are aware of what they did.

By law we have to put all offers forward to the seller and confirm them in writing to both the seller and the potential purchaser as we did on this occasion. Other people did view the property between this lady viewing and the vendor accepting her offer which resulted in another person offering. If we had not put the second offer forward we would not only have broken laws but this would have been completely unethical. As an agent it is not our decision as to which offer the property owner accepts and it is unfortunate that in this instance the seller changed their mind but it is their right to sell their property to who they choose and at what price. The lady in question was given the opportunity to raise her offer which she declined. We can assure any purchaser or seller that we follow and adhere to all legislation, keep all of our actions completely transparent and would never ever consider doing anything unethical. We are aware that we are unable to please every potential purchaser who has lost a property through us but to obtain a better view of our service we would recommend that people visit our website and see the many, many testimonial written about us: http://www.raineandco.com/testimonials

Complaints Procedure

Raine and Co In-House Complaints Procedure At Raine and Co we are committed to providing a professional service to all of our clients and customers. When something goes wrong, we need you to tell us about it. This will help to improve our standards. If you have a compliant regarding our Sales, Lettings and Management offices, please put it in writing, including as much detail as possible. We have eight weeks to consider your complaint. If we have not resolved it within this time you may refer your complaint to The Property Ombudsman. What will happen next? • We will send you a letter acknowledging receipt of your complaint within three working days of receiving it, enclosing a copy of this procedure. • We will then investigate your compliant. This will normally be dealt with by the office manager who will review your file and speak to the member of staff you dealt with you. A formal written outcome of our investigation will be sent to you within fifteen working days of sending the acknowledgement letter. • If, at this stage, you are not satisfied, you should contact us again and we will arrange for a separate review to take place by a senior member of staff. • We will write to you within fifteen working days of receiving your request for a review, confirming our final viewpoint on the matter. If you remain dissatisfied, you can then contact The Property Ombudsman to request an independent review: The Property Ombudsman LTD Milford House 43-45 Milford Street Salisbury Wiltshire SP1 2BP Tel: (01722) 333306 www.tpos.co.uk Please not the following: You will need to submit your complaint to The Property Ombudsman within six months of receiving our final viewpoint letter, including any evidence to support your case.
