I was recommended by a friend to use Andrew Hardley to sell the lease for my business. Started off so well. He told me that he was going to be taking a £5K deposit off which ever of the 2 hopeful tenants. Needless to say the deposit was not taken. Eventually after covid closure I managed to get hold of said hopeful tenant who said he was not going through with the lease, having got solicitor to draw up lease etc. Andrew did not follow up this potential tenant. The business was remarketed, . Along came another hopeful tenant. No deposit take Immediately. I was assured by Andrew that the potential tenant was good for the money etc. No references were taken, at a later date I find the tenant has been insolvent in 2018. I was told that the deposit eventually collected by Andrew would be passed to my solicitor. It was eventually but only after his fees had been taken out. I had.no invoice to claim the VAT back, eventually supplied by my solicitor. Needless to say the tenant has moved on, surrendered the lease back to me. IF only Andrew had done his job correctly I would not be several thousand pounds down. He then had the audacity to email me offering to remarket the business. My reply being “I presume this is a joke.

This transaction was dealt with by Bradleys Countrywide Norfolk. We do not recognise Mrs Foulds description of the transaction which occurred nearly a year ago and are surprised it has taken her so long to comment . At all times we acted professionally and in her best interests and secured a tenant who paid a premium and rent considerably in excess of the market figure for Norwich at that time. It was not and is not part of our remit to ensure the financial bona fides of prospective purchasers, that is the responsibility of the vendor. We can only assume Mrs Foulds completed her own due diligence as she assigned a lease to the tenant. As is normal practice, our fee note was forwarded to the vendors solicitor for settlement from the completion funds and a copy of our statement of account would have been submitted by them with their own account . On being advised by the tenant he was surrendering the lease we spent time trying to rescue the situation but to no avail. Whilst Mrs Foulds now has the premises to re-assign, she has made a considerable financial gain retaining both the premium paid less costs and also benefitting from the enhancements to her premises from the considerable sums spent by the tenant. We offered our services to Mrs Foulds to find another tenant which she has declined ; we wish her well in finding a tenant who will pay the premium and rent she wishes to achieve. Andrew – I have no idea why you do not recognise my account of the events. Which part do you not recognise? May be you need to read your companies web site – it states:- “References are taken up on a buyer to obtain landlords approval (applicable to leasehold businesses only)”. You assured me that the incoming tenant was good for the money, so I trusted you to have done searches. You stated to me that Joe was good for the money, I can remember asking what proof you had, “I’ve seen the accounts” was your answer. This is the first time I have tried to lease a property/business, so put my faith in you, that was obviously a mistake. When things started to go wrong some 8 months down the line, I did some searches, and it didn’t take me long to find Joe Barnard had been insolvent in 2018. You should have found that out when you did references (as advertised) and told me. The premium was fair for the quality of fixtures and fittings, the rent was not in excess for the market figure as it was negotiated down by several thousand pounds, but that’s now irrelevant as the last rent was not paid, so I’m financially down. Yes I am now able to re-assign a lease but I am so much out of pocket as I am owed over £5k from JB1 Hospitality Ltd and putting right all the damage done to the premises. There was a vast amount of money wasted on what you call enhancements to the premises, which is why we are now having to clear out all the junk left behind, deep clean the kitchen, replace door which has a large hole in it, replace ceiling lights, cctv camera which was ripped off the wall and broken in a fit of temper. SO no I am not going to benefit from a payment of another premium. I still do not feel you did the best job for me. A refund of some of your fees would be much appreciated as you obviously didn’t do the best for me and cut corners ie: referencing etc.
