This property was marketed for £399,950, following which an offer I made at £395,000 was accepted. As a gesture of commitment in proceeding with this property transaction, both myself and the vendor put down a £2000 holding deposit, which was held by the agents. The written and signed agreement stated that the property is off the market and no longer show by ANY agents to other prospective buyers. 3 weeks into it, after I had already instructed a solicitor and the bank to arrange a valuation, the agents called me, stating that without their knowledge, the vendor had 'privately' showed the flat to a private buyer, and now wanted me to match the 'private buyer's ' offer of £425,000!!! This was £30,000 over the agreed price and even £25,000 over the original asking price. The agents were pushing for me to accept this, but I declined. They then refunded me the £2000, and assured me they didn't have anything to do with this, and even stated that they were 'frustrated with the vendor for his actions!!'. Lo and behold, within a few hours of our discussion, the property was back on the market, this time at £435,000!! (see http://www.rightmove.co.uk/property-for-sale/property-49600096.html), marketed by the SAME AGENTS. I know offers fall through but I would have thought they would have at least have some decency to be honest. Extremely disappointed, all in all 3 weeks of wasted time and also financial loss. Personally, I would advise against entering any negotiations or dealing with this agency, or this vendor.

29 May 2015An update! After I complained to London Habitat they basically lied about a private buyer (see story above), and that they blatantly put the property was back on the market within a couple of hours of me refusing to match the 'private buyers increased price', they said they had 'advertised the property again by mistake'. They then took down the property from the website, but thankfully I got screenshots of when it first appeared! (which have been sent to the property ombudsmen). They have now (as of 29th of May 2015), put the same property on for sale again, but have taken different photos of the flat, and also changed the square footage (for some reason, the flat seems to have magically grown from 499 sq ft to 503 sq ft!) - stating that today is the first day they have advertised this property! Liars. Please beware if you are looking to purchase FLAT41 WALTHAM HOUSE- owner and agents engaging in 'ghost gazumping'.

This agent puts up new flats every day and there dud adverts as when i called up to ask about the properties they give me lame excuses why they cant be viewed but then they ask can we take details for you and what your looking for and offer us flats much more expensive. Kindly note that legally, letting agents need to publish information about their tenancy fees, government-approved redress schemes and client money protection schemes on their website and on third party websites (on which agents are listed). For properties to lease/rent in England, agents need to keep this information up to date and precise on allAgents or specify within the property description.
