They wanted to charge pro rata for early termination to the tenant although it was the landlord who used the break clause. There is a clause in their contract that allows them to do so. They wanted to charge for inventory check out and cleaning that never happened and there is another clause that allowed them to do so. They tried to go over the three month period after property was vacated so the the tenancy protection scheme wouldn't get involved (although their contract says they should pay back within a month) but they didn't manage. When the TDS got involved they lied and said the tenant broke to terms of contract by leaving early but TDS asked for evidence they couldn't provide so the TDS gave me my money back. They did print out a home made check out inventory invoice for £110 which they got away with but again with the cleaning they were asked for evidence and they didn't have it so they lost that money. More than a year later (so that the Property Redress Scheme wouldn't bother them) they took me to court using the old address I used to rent from them although their contract had a forwarding address they required me to provide. I didn't hear from them or the court until they already had achieved a judgement by default and obtained a writ of control by which bailiffs turned up at my house to rob me of my money on their behalf. I spent more money applying to set aside the decision and they were reprimanded by the judge in barnet county court as well as ordered to pay it all back. Now they are taking me back to court because they somehow think they only lost the first time because they used the wrong address even though the judge told them clearly they should never had challenged the TDS decision, let alone pretend in their claim that the decision never happened and present no evidence of it. This second time they have also failed to provide the TDS decision where it clearly states why I was awarded my money back. I am providing it in my defence though.

5 Dec 2019You lied to TDS and when they asked you for evidence you failed to provide it. No judge will consider it correct to award you anything on the basis of animaginary mistake by TDS. Please read the document they produced on the 11th of June 2018, and please send us your bundle of evidence like we've requested via email. It is your duty as a claimant

13 Dec 2019It sure will. I the meantime, everything I stated in my review is 100% factual. You lied to TDS when they asked you following the opening of the dispute in May 2018. What you wrote in the present claim is in contradiction with what you told TDS. With your new claim you are intending to get a judge to enforce two abusive clauses in your contract. One that allows you to charge a tenant for landlord's decision to terminate early. One that allows you to charge for cleaning and inventory check out (that never happened and never will), explicitly saying that this is regardless of how you hand in a property. Very convenient for you. As for sharing evidence you have no obligation to share it but it does look good if you show the judge you did what you could to find understanding whit the other party. I know, I know. Being agreeable is not your style. Your attitude is more like mafia style

For properties to lease/rent in England, agents need to keep this information up to date and precise on allAgents or specify within the property description.
