I am certainly not happy, I unwittingly gave deposit to hold the property which was asked of me before all the checks had been done .I did not realise my current tenancy ends in three months with no break clause which was made clear after the checks you made with my current landlord causing me to not take up the property until the end of the agreement. Holdens say they cannot return the deposit which I feel is very unfair as they should have explained more clearly if the checks fail deposit is not refundable. I dealt with Zafran Nizar who did not make this clear. I will refer this matter to the Property Ombudsman or Property Redress Scheme and the local trading standards.

30 Mar 2023Hi Iftikhar, unfortunately the reason you lost the deposit is because you failed the reference check carried out by a third party reference company which we forwarded on to you. It states the reason and is irrefutable and I would rather not attach it so people can clearly see the reason why we failed your application but if needed we will. I have reviewed the Letting form you completed and signed which clearly explains the process of submitting a deposit on a property. It clearly states point 8 if you decide not to take occupation or your reference proves unacceptable you may be liable to pay the abortive costs of one weeks rent to cover costs incurred. You placed the deposit on the 13th of March after your viewing of the property and the property was removed from the market. You signed the offer form and the landlord was informed that you would be moving in. You completed our reference application form and these were sent to a third party reference company but after the report came back on the 22nd of March we had no choice but to inform you and the landlord you had failed. We have the copies of your signed offer form and the reference report which clearly show the chain of events. We would have loved to have you as a tenant but for the reasons made clear in the report had no alternative. We wish you all the best going forward.
