We had a very similar experience to the one that happened to the previous reviewer Emma. Me and my girlfriend booked a viewing for a property on a Thursday, 40 mins after the viewing we let the agent Olga know that we wanted to make an offer, the next day our reservation deposit was in the agency's bank account. All that was left to do was to wait for the landlord's reply. Next Monday we asked if they had any news from the landlord, they said that the property wasn't on the market anymore because the landlord accepted a private offer. I immediately pointed out that that sounded strange, usually landlords have an exclusive relationship with the agency, otherwise they would just waste the agents' and potential customers' time by accepting private offers. I had been told that ideally that would be the case, but not in this occasion, the landlord accepted an offer made by someone close to him, possibly a relative or a friend, they were not too sure about it. It clearly sounds fishy, if I were an agent and I wasted my time and on top of it I lost the opportunity to get a commission, I would definitely like to know exactly what happened. Even more ridiculous, at the moment of writing three days passed since they turned our offer down and the property in question is still on their website with the label

8 Dec 2015Dear Andrea, I am sorry you felt the need to complain. We understand that renting a new property can be a stressful process and it is disappointing when you miss out on a property. When you put down a reservation deposit on a property it is reserved for you which means we stop doing viewings of the said property and we process your offer and conduct referencing. And that is what happened as well in case of your offer. Now, we are not the property owner. We are a letting agent. That means that ultimately it is the landlord who has the final say. A landlord can instruct one agent to market their property or several. And often landlords will also advertise themselves at the same time. Therefore, it may happen that a landlord has more than one offer at the same time and it is up to him which offer he chooses to accept. In practice it means that putting down a deposit does not guarantee a tenancy (as explained clearly in all documentation given to you prior to making an offer). As soon as we learnt that the landlord had another offer he chose and your offer was rejected we asked for your bank account details and returned the deposit to you in full on the same day.
