I was gazumped just before exchange on a property in crystal palace. To give some background this property had been listed for over a year at an extremely high price. When my offer was finally accepted I was told that the vendor (a property developer) was a close associate of Luke Wooster and wanted a quick exchange is 28 days. That suited me as I had nowhere to sell. The vendor then proceeded to wait three weeks before sending any information to my solicitor. My suspicions were immediately raised that they were stalling in the hope of finding another buyer, although I had no proof. Things got even stranger when, as a result of my survey that revealed major problems with the refit of the property (entire roof leaking), Luke Wooster himself rang and aggressively tried to persuade me to continue without reducing the price and still having not received any paperwork from the vendor. Still I naively gave Mr. Wooster the benefit of the doubt and I continued with the sale spending more money on solicitor fees. The weekend before we were set for exchange ( 3 months after my initial offer was accepted) I had a last viewing. Everything seemed finally on track, and I met Zoe Matheson who as excited for me. Then the dreaded called came the following Tuesday. I was told that a previous viewer ( from months ago) had come in with a higher offer. But, Zoe hadn't told the vendor yet..would I like to raise mine? An estate agent should immediately tell their client that a new offer has come in. After finding some extra money I then raised my offer two days later, but the other buyers had already exchanged! Amazingly, it only took them a 3 days to exchange, whereas it took me 3 months. And all from someone who wanted to sell the property quickly- could they have been there all along and I was the backup option? Perhaps - but I will never know the truth and I lost thousands of pounds in the process. Of course estate agents never take responsibility for gazumping, blaming it all on the client. But in this situation, when Luke Wooster himself was closely associated with the sale, I want people to be aware of how he treats his customers.

Wooster & Stock are obliged by law to put forward every offer received prior to exchange. On this occasion, a cash offer was received from an individual who had previously seen the property prior to going under offer. They were in a position to exchange within a matter of days. The vendor, from the outset, agreed to the initial sale on the proviso of a 28 day exchange, and this sale was delayed as the purchaser was requiring a reduction in the price and this was only going to be entertained if a quick exchange was forthcoming. Every opportunity was given to the initial buyer to exchange.

What agent could do to change your mind?
The agent could have addressed issues within a reasonable time scale. The agent could have stopped the blatant lies. The agent could have kept their promises. The agent could have stopped being excessively rude. The agent could have performed the role of an agency. The agency could have provided a basic level of customer service. The agency failed.
