When you climbed into the loft and fell through the ceiling, this was damage to the property not maintenance. As we have previously explained, as a tenant you have a responsibility to insure yourself against accidental damage to a landlord’s property. You chose not to insure yourself against such risks and therefore, are responsible to meet the cost of the repairs yourself or, compensate the landlord for their costs and losses. We have previously explained your position in some detail, I’m sorry, we could not give you the response you were looking for.
We first approached your guarantor because you had rent arrears and were not responding to our attempts to contact you. We continued to maintain regular contact with your guarantor, because we had a contractual obligation to do so; the guarantor is a third party to the tenancy agreement for which they have legal responsibility and therefore, can expect to be kept informed.
Because you had not kept to the original terms of your tenancy agreement, I’m sorry, we could not offer you a new tenancy agreement when you separated from your partner, who was himself jointly responsible for these breaches.
When you moved out of the property, in accordance with your tenancy agreement, you were expected to clean the property to a professional standard. However, the property was returned very dirty and untidy, such that the contractors instructed to repair the ceiling, refused to begin work until the property had first been professionally cleaned.
When renting the property, you had a contractual obligation to pay the rent and keep the property in a good state of condition, taking reasonable care of its fixtures and fittings. I was sorry to hear that you had experienced personal problems, however, these matters did not mitigate your responsibility to the contractual obligations of your tenancy agreement.
