A relative of mine recently saw a property online that they wanted to view. It was advertised by "Nofax properties" on various independent agent websites. After a quick check, I found out that that company was "dissolved"!

The location of the property was convenient and from the online description it was almost perfect for purpose! Contact was made with 'the agent' and a viewing was subsequently arranged. All seemed fine and after a few back and forth regarding further queries on the property my relative was advised to put a holding deposit to secure the property so that the latter is then taken off the market once payment is made. Payment was effectively done, and a receipt was raised following confirmation of payment but the property was still on the market and was also being advertised by another independent agent.

The Business Account name provided for the deposit contained the agent's own initials. Although technically there may be nothing wrong with that, the practice being executed was rather shady as the agent is in reality an employee of the Landlord (the company), aside looking like he's a director of his own company! To me it was a rather dubious method that clouds transparency and individual honesty.

Upon querying what the holding deposit covered, the agent replied that it is refundable once the offer is accepted by the landlord i.e. effectively his employer! But he failed to reiterate that it would take the property off the market as he said previously.

My relative received a call later that day by the agent, informing them that unfortunately there has been a higher offer by someone else who came through the other independent agent and that the property is no longer available unless a match and/or higher offer is made to secure the apartment! And the landlord (the company) has allegedly accepted the higher offer.

The agent suggested that a second property has now become available in the same block (how coincidental) and that it looks like the one that was viewed by my relative. He advise to view it and that he would ensure that all will go "smoothly" and he would fight with the landlord (the same company) for my relative's sake.

As I mentioned above, the agent works for the same Landlord (Nofax Enterprises Ltd) but uses what looks like an independent structure to bleak or cloud any potential link between himself and his employers. The main enterprise is run by the same directors who own several other Real Estate/property companies trading under different names! He was hesitant to confirm this to me when I quizzed him ( I had researched a little prior to meeting with him). I stated how their practices were deceptive and unethical to which he evidently disagreed. He also stated that he'd done my relative a favour by securing a discount on the price of the property because he is client focused and looks out for his client's best interests (how noble!) Later on I found out that it was a complete lie as the property was being advertised at an even lower price by another agent, than the "discount" he'd allegedly secured! It's despicable to be having such dishonest, distasteful, unethical individuals in this market and where customers are prey to such rogue tactics! More despicably, there are no regulations that can curb such ugly and nasty practice!
