I would not recommend Hyman Hill. I recently chose them as the agent to sell my property and after a very disappointing experience, I would like to share it with any potential future customers of theirs.
Christian from the Shoreham branch came to my house and breezed over the contract, failing to explain aspects which I later found out were key and should have been discussed clearly to ensure my understanding.
After feeling unhappy during the first week of him marketing my property due to the fact he failed to draw up a floor plan, include photography of all the rooms and describe key selling points of my house, I decided to exercise my right to leave within the '14 day cooling off period' and give another agent the opportunity to do a better job.
When I explained I wanted to leave the contract within the '14 day cooling off period' I was told by Christian that due to him marketing within that period, I had no right to leave without incurring a fee of £180.
After discussing this matter with a solicitor I was given the following advice which agents should be adhering to;
In June 2014, the Consumer Contract Regulations came into force, which gave rights to consumers to cancel a contract that had been made at a distance or “off premises”, without any reason other than they have changed their mind.
The time in which a client has the right to cancel, known as the “cooling-off” period, is 14 days from the day the contract is entered into providing the client is made aware of their right to cancel.
Take caution when providing services inside the 14 day cooling off period – If your clients want you to begin providing a service within the 14 day cancellation period, you should gain their written consent and advise them that if they later cancel your contract they will need to pay for any services delivered until the point at which they cancel. If you do fail to do so, the consumer may not be liable for any costs that you have incurred during this time.
Inform your client – Once the contract is signed, you should provide your clients with a copy of the signed contracts. The burden of proof that the required information has been given rests with the trader, so it is in your interests to keep good, clear taking caution in providing services within the 14 day cooling off period.
Chritian failed to explain to me the fact that I was giving up my right to back out of the contract within the 14 days cooling off period without a fee therefore he failed to ensure my understanding regarding this point.
He also failed to provide me with a copy of the contract leaving me with no point of reference.
When I brought this to his attention he lied about giving me a copy of the contract. He then gave a very unprofessional, sarcastic answer regarding the fee, suggesting I ask my new agent to pay it for me.
When I asked him if he could honestly tell me that he believes he carried out this process honestly and with integrity, he chose to ignore me which speaks volumes.
I urge anyone considering to engage with their services to ensure that you know your rights and you proceed with caution.
