Encountered Mark Abrahams as a buyer on a property. I found Mark to be very unprofessional, rude, however I had to deal with him as he was the nominated EA for the seller. Very early on trust diminished with Mark as he wanted me to pay a £1,000 fee to show I am a 'serious buyer', and told me he wouldn't take the property off the market unless I did so. He warned me because of this decision that 'gazumping is real when purchasing property'.
The basic processes seemed to be delayed as from the time the offer was accepted, he failed to communicate with my solicitors to issue a sale of memorandum, meaning draft contracts couldn't be exchanged and the solicitors couldn't get on with their job. I was given excuses such as 'the vendors are elderly' and 'the vendors are choosing between two solicitors'. I feel sorry for the seller as she informed me she wanted a quick sale on the property. She wasn't elderly plus after getting her solicitor details from her myself she informed me the name and address of her chosen solicitor.
A survey was held and after contacting the vendor myself to get her solicitor details, it became apparent from the two solicitors talking to each other that the seller's solicitors had no record of my offer. Making matters worse they (sellers solicitors) had details of another interested buyer who put in what I am told was a lower offer after I had record of my offer being accepted. This is known as a contract race and all interested parties should be informed that this is something they have entered into.
Last week, I received an email from Mark saying the seller wished to pull out of selling the property to me. I lost money on a survey and expenses and fear I would have lost a further £1,000 had I paid it.
Solicitors have a duty to ensure buyers and sellers are treated fairly. The above review is only a snapshot of my experience with Mark Abrahams at Mark Ashley & Company.
