While Knights excelled at marketing our home and finding new tenants quickly, the managed service did not deliver.
Unhappy with the service and how our concerns were being addressed, we wrote to Knights to terminate services. Clause 7.3 was referred to (while tenants introduced by Knights remain in the property a fee is due). We were free to leave on the condition the tenancy was terminated and the tenants vacate the property (this we were unable to find in the terms).
Knights did offer a non-managed service at a reduced %, however given our dissatisfaction and that we wished to part company, we considered this unfair.
Reluctantly we served notice on the tenants.
When Knights did not make contact with us to discuss the future of the tenancy in time for notices to be served before the end of the fixed term, the tenancy became periodic.
Knights went on to deduct an annual fee from the last 2 months' rent, despite the tenants only remaining for 2 of the 12 months, after which Knights would not be providing a service.
All was not lost however when the Property Ombudsman (tpos) awarded for the managed fees post-tenancy to be returned to us in full with modest compensation.
Whenever we have come to enlist the services of agents since, we have ensured the agent is a member of a professional body (RICS, ARLA, etc.) and that the fee structure and termination policy are consistent with the industry.
